Nywhash respects intellectual property rights and expects the content hosted on its infrastructure to be compliant with the law. This document explains the content removal processes in accordance with the Law No. 5651 on Regulation of Publications on the Internet and Combating Crimes Committed Through These Publications (Turkish Law) and international DMCA (Digital Millennium Copyright Act) standards.

Nywhash operates as an official registered "Hosting Provider" (Yer Sağlayıcı) under the Information Technologies and Communication Authority (BTK) of Turkey. Under Law No. 5651, we are not obliged to check the accuracy or copyright status of the content hosted on our servers; however, when we receive a valid "Notice and Take Down" infringement report, we are obliged to take the necessary legal actions as soon as possible.

1. OVERVIEW

If you believe that a website hosted on the Nywhash infrastructure (Shared Hosting, VDS, or Cloud services) infringes your copyrights or violates laws (phishing, malware, illegal content, etc.), you can submit a notification through our official channels.

2. HOW TO SUBMIT A DMCA NOTICE?

Copyright infringement notifications must be made in writing and include a signature (physical or digital). You can send your notifications directly to [email protected].

3. REQUIREMENTS FOR A VALID NOTICE

In order for content to be removed, your application must contain the following elements:

  • A clear description or link of the work claimed to have been infringed.
  • The full URL address of the file/page causing the infringement hosted on Nywhash servers.
  • Your name, surname, address, and telephone information so that we can contact you.
  • "A statement of good faith that the content is not authorized by the copyright owner."
  • "A statement that the information provided is correct and that you are authorized to make the infringement notification."

4. COUNTER-NOTICE

A customer whose content has been removed can submit a counter-notice if they believe that the transaction was made as a result of a mistake or misidentification. Following the counter-notice, the content can be put back online after a certain period of time, unless the complaining party initiates a legal lawsuit process.

5. OTHER ABUSE

You can also report the following situations, not just copyright issues:

  • Phishing: Bank or social media imitation sites.
  • Malware: Files hosting or spreading malicious software.
  • Spam: Unauthorized bulk emailing via our servers.
  • Illegal Content: Any material contrary to local laws.

6. PROCESS AND SANCTIONS

When a valid notice is received, the process proceeds as follows:

  1. The notification is verified by our technical team.
  2. The relevant customer is warned and given time to remove the content (or suspended immediately depending on the severity of the infringement).
  3. In case of repeated infringements (Repeat Offender Policy), the customer's service is permanently terminated and no refund is made.
